You want to work as a real estate broker in Riyadh. Which body issues the FAL licence you need before you can broker any deal?
- The Ministry of Commerce
- The Real Estate General Authority (REGA)
- The Ministry of Justice (Najiz)
- The Saudi Central Bank (SAMA)
Under the Real Estate Brokerage Law, brokerage and real estate services cannot be practised without a licence from REGA. FAL is the name of REGA's brokerage licensing platform. The Ministry of Commerce only issues the commercial registration an establishment also needs.
REGA, Real Estate Brokerage Law (Royal Decree M/130), Article 4 (2022-06) Your brokerage contract with a seller in Jeddah says nothing about the commission rate. What does the Real Estate Brokerage Law set by default on a sale?
- 2% of the sale price
- 5% of the sale price
- 1% of the sale price
- 2.5% of the sale price
Article 14 sets the commission at 2.5% of the deal value on a sale, unless the parties to the brokerage contract agree otherwise in writing. If several parties hire the broker for the same deal, the total still cannot exceed that rate.
REGA, Real Estate Brokerage Law (Royal Decree M/130), Article 14 (2022-06) You find a tenant for a 3 year lease of a villa in Riyadh. Unless agreed otherwise in writing, what is your legal commission based on?
- 2.5% of the first year's rent only
- 2.5% of the total rent for all 3 years
- One month's rent
- 5% of the first year's rent
For leases, the law sets the commission at 2.5% of the first year's rent only, whatever the length of the lease. The one month's rent habit some brokers bring from other markets is not the Saudi legal rate.
Ejar, Real Estate Brokerage Law text (Article 14) (2026-10) A landlord signed a brokerage contract with you to find a tenant. The tenant never signed anything with you. Who pays your commission under the law?
- The tenant, because they benefit from the unit
- Landlord and tenant, half each
- The landlord, as the party that contracted you
- Nobody, because commission is only due on sales
Article 14 says the commission is paid by the party who concluded the brokerage contract with the broker. If you want the tenant to pay, you need a written brokerage contract with the tenant too.
Saudipedia, Real Estate Brokerage Law (2022-06) A seller agrees verbally to let you market his apartment and promises you a commission. What does the law require for the brokerage contract to be enforceable?
- A WhatsApp message confirming the deal is enough
- It must be written and deposited with REGA on the electronic platform
- It must be notarised at the Ministry of Justice
- It must be registered on Ejar within 30 days
Article 7 requires the brokerage contract to be in writing and a copy deposited with REGA, otherwise it cannot be enforced. The implementing regulations require brokers to use REGA approved templates on the electronic platform.
REGA, Real Estate Brokerage Law (Royal Decree M/130), Article 7 (2022-06) A brokerage contract was signed and deposited but the parties forgot to write an end date. How long does it run?
- 30 days
- One year
- Until the property is sold
- 90 days from signing
The contract must have a definite term, and if none is stated it lasts 90 days from conclusion. You keep your right to commission if the deal closes within the term or within two months after it ends, provided you can prove you brokered it.
REGA, Real Estate Brokerage Law (Royal Decree M/130), Articles 7 and 15 (2022-06) A buyer asks why the seller's title in a Riyadh district already covered by the National Real Estate Registry (RER) is considered so safe. What is the best answer?
- Entries in the registry are conclusive evidence of ownership, and each unit has its own record and number
- The Ministry of Justice reprints the paper deed every year
- The registry only lists mortgages, not owners
- Registration is optional, so the paper deed still decides
Under the Real Estate Registration Law (Royal Decree M/91), REGA runs a registry where each unit has its own record, and in mandatory registration areas registered entries are conclusive evidence of ownership. Transfers, mortgages and encumbrances there must be registered on the RER platform.
Trowers & Hamlins, Saudi Arabia's unified digital transfer and title registration framework (2026-07) A buyer wants to show commitment and offers a 10% down payment (arboon) on a villa. What does the brokerage law say?
- Down payments are forbidden in Saudi Arabia
- The broker may keep it as a guarantee for the commission
- The down payment is capped at 5% of the deal, and anything above counts as an advance payment
- Any amount is fine if the buyer signs
Article 13 caps the down payment at 5% of the transaction amount; any excess is treated as an advance on the price. It only counts as a down payment if stated in writing, and the broker can never hold it as security for the commission.
REGA, Real Estate Brokerage Law (Royal Decree M/130), Article 13 (2022-06) A buyer walks away from a deal for his own reasons and the seller becomes entitled to keep the down payment. Your brokerage contract is silent on this case. What are you entitled to?
- Nothing, because the sale did not close
- 25% of the down payment
- The full 2.5% commission on the price
- 50% of the down payment
Article 21 of the implementing regulations gives the broker 25% of the down payment when the seller or lessor becomes entitled to it and the deal is not completed, unless the brokerage contract says otherwise.
REGA, Implementing Regulations of the Real Estate Brokerage Law, Article 21 (2023-01) You want to post a listing for a Jeddah apartment on Instagram and on a property portal. What do you need from REGA first?
- A real estate advertising licence for that ad, which carries no licence fee
- Nothing, social media is not covered by the law
- One advertising licence per year, costing SAR 5,000
- A permit from the Ministry of Media
The implementing regulations require a real estate advertising licence for each advertisement, and REGA exempts advertising licences from licence fees. The law covers websites and social media, and every ad must show the broker's name and licence number.
REGA, Implementing Regulations of the Real Estate Brokerage Law, Articles 3, 4 and 6 (2023-01) What is the highest fine the Real Estate Brokerage Law allows for a single violation, before any doubling for a repeat?
- SAR 50,000
- SAR 1,000,000
- SAR 200,000
- SAR 10,000
Penalties range from a warning and licence suspension of up to one year to revocation or a fine of up to SAR 200,000. The fine can be doubled if the violation is repeated within three years.
REGA, Real Estate Brokerage Law (Royal Decree M/130), Article 19 (2022-06) According to the brokerage implementing regulations, how long is a REGA licence valid once issued?
- For life, with no renewal
- Three years, renewable once
- Six months
- One year, which may be extended for a period of up to five years
Article 7 states that the licence is valid for one year and may be extended for a period not exceeding five years. Renewal requests go in within the 60 days before expiry, with the renewal fee paid.
REGA, Implementing Regulations of the Real Estate Brokerage Law, Articles 7 and 8 (2023-01) An agency in Dammam applies for an establishment FAL licence for brokerage and marketing. Which set of conditions does REGA list?
- A licence from the Saudi Council of Engineers and a bank guarantee
- A commercial registration with activity 682010, and a manager who completed the brokerage, marketing and e-marketing courses
- Ten licensed brokers on staff and an office in a mall
- A SAMA approval and SAR 1 million in paid up capital
REGA requires a valid commercial registration that includes real estate brokerage (code 682010), and the manager in charge must complete the qualification program: Real Estate Brokerage, Real Estate Marketing and E-Real Estate Marketing courses. The establishment fee shown by REGA is SAR 1,000 per year.
REGA, Issuing FAL licence for brokerage and marketing for establishments (accessed Oct 2026) (2026-10) A non-Saudi broker with ten years of experience in Dubai wants to be hired as a property sales and rental broker by a Riyadh agency. What does the Saudization decision say about this job?
- It is 100% reserved for Saudi nationals
- It is open to anyone with a FAL licence
- Expats can hold it if the agency is 70% Saudi
- Expats can hold it for their first two years
Since 1 October 2021 the Ministry of Human Resources has localised 100% of real estate brokerage jobs, including real estate broker, sales and rental broker and real estate marketer. Other real estate activity roles are localised at 70%, with at least one Saudi per establishment.
Ministry of Human Resources and Social Development, localisation of real estate activities takes effect (2021-10) A landlord asks why you insist on the unified Ejar lease rather than his own lawyer's contract. What is the strongest legal reason?
- Ejar contracts are cheaper to print
- Only Ejar contracts allow a rent paid in cash
- A unified Ejar contract is an enforcement instrument that can go straight to the execution court, and unregistered leases have no judicial effect
- Ejar automatically adds 15% VAT, which protects the landlord
The unified Ejar contract can be executed directly at the execution courts, so unpaid rent is chased without a full lawsuit. Under Council of Ministers Resolution 292, leases not registered on Ejar have no judicial or administrative effect. Adding custom clauses can make it lose its enforcement status.
Al Tamimi & Co, Ejar contracts in the Kingdom of Saudi Arabia (2024-06) A landlord in Riyadh wants to raise the rent of his existing tenant by 8% at renewal in 2026. What do you tell him?
- Fine, up to 10% a year is allowed
- Not possible: increases are suspended for five years in Riyadh from 25 September 2025, for residential and commercial leases
- Only allowed if the tenant agrees by WhatsApp
- The freeze applies only to commercial leases
A royal decree suspended annual increases in total rental value within Riyadh's urban boundary for five years from 25 September 2025. It covers new and existing residential and commercial leases, and all leases must be registered on Ejar.
Arabian Business, Saudi Arabia freezes rent increases in Riyadh for 5 years (2025-09) Under the Riyadh rent rules of September 2025, a flat that was rented before is now vacant. How is the rent for the next tenant set?
- Freely agreed between the landlord and the new tenant
- By REGA's average rent for the district
- At the last registered Ejar rent for that unit
- At the last rent plus 5%
For a previously leased vacant unit, the rent is fixed at the value of the last contract registered on Ejar. Only units never rented before can have their first rent agreed freely, and landlords may object in limited cases such as major renovations or a last lease signed before 2024.
BSA Law, Riyadh introduces a five year rent stabilization plan (2025-09) What tax applies to the sale of a ready apartment in Riyadh?
- VAT at 15% of the price
- Real Estate Transaction Tax (RETT) at 5% of the value, with no VAT on the sale
- RETT at 2.5% plus VAT at 15%
- No tax at all on property sales
RETT is 5% of the property's value, and real estate sales are exempt from VAT since RETT replaced VAT on them. The taxable value is the agreed price, but not less than fair market value.
ZATCA, Simplified guideline on Real Estate Transaction Tax (2024-05) Who is liable to pay the 5% RETT when a property is sold, if the contract says nothing?
- The seller (the disposer), though the contract can shift the cost to the buyer
- Always the buyer, by law
- The broker, out of the commission
- Seller and buyer, half each by law
ZATCA's rule is that the seller collects and is liable for RETT, and the buyer can become jointly liable if they cause non payment. Parties can agree in the contract that the buyer bears the cost, so always write the agreed split down.
ZATCA, Detailed guideline for RETT (version 6), section 4.5 (2026-05) A young Saudi couple is buying their first home for SAR 900,000 and holds the Ministry of Housing first home certificate. What happens with RETT?
- They get a 50% discount on RETT
- RETT is waived only for off-plan homes
- They pay the full SAR 45,000 and claim it back later
- The state bears the RETT, since the price is within the SAR 1,000,000 limit
The state bears RETT on a citizen's first home up to SAR 1,000,000 of the price. The buyer needs the certificate from the housing ministry, and the seller submits the transaction through ZATCA's RETT service.
ZATCA, Simplified guideline on Real Estate Transaction Tax (2024-05) Under the non-Saudi ownership law in force since January 2026, where can a foreign national legally resident in Riyadh buy a home for himself?
- Anywhere in the Kingdom, with no limit
- Nowhere, only GCC nationals can own
- Inside the designated zones, plus one residential property for personal use outside them (not in Makkah or Madinah)
- Only in NEOM and the Red Sea projects
Non-Saudis may own within geographic zones approved by the Council of Ministers and mapped by REGA. A legally resident non-Saudi individual may also own one home for personal use outside the zones, except in Makkah and Madinah. GCC nationals keep their own, more favourable regime.
Deloitte, Implementing Regulations to the Non-Saudi Real Estate Ownership Law (2026-07) A non-Saudi investor asks to buy an apartment in a designated zone of Makkah. What condition applies to individual buyers there?
- They must be Muslim
- They must hold Premium Residency for five years
- They must be GCC nationals
- They must buy through a Saudi spouse
In Makkah and Madinah, ownership by non-Saudi individuals is restricted to Muslims and only inside the designated zones. A resident's one home outside the zones cannot be in these two cities either.
King & Spalding, Saudi Arabia introduces new legal framework for foreign ownership of real estate (2025-07) Under the implementing regulations approved in June 2026, what fee does REGA charge on a disposal by a non-Saudi in Riyadh, on top of RETT?
- 10% of the value
- 5% of the value in every city
- 2% of the value in Riyadh, Jeddah, Makkah and Madinah, and 0% outside these four cities
- No fee, only RETT
The law allows a fee of up to 5%, but the regulations apply 2% in Riyadh, Makkah, Madinah and Jeddah Governorate, and 0% elsewhere and in listed cases such as inheritance. The 5% RETT still applies on top.
Deloitte, Implementing Regulations to the Non-Saudi Real Estate Ownership Law (2026-07) A buyer insists on paying a large part of the price in cash and refuses to explain where it comes from. You suspect money laundering. What must you do?
- Tell the buyer you are reporting him so he can explain
- Report it immediately to the General Directorate of Financial Intelligence, without warning the client
- Just refuse the cash and continue with a bank transfer
- Ask the seller to decide
REGA requires brokers to report suspicious transactions immediately to the General Directorate of Financial Intelligence (SAFIU), using the unified template. Tipping off the client that a report was made or that the deal is delayed for suspicion is forbidden.
REGA, Circular confirming brokers' duty to report suspicious ML/TF transactions (2026-10) Under REGA's AML guide for brokers, how long must you keep client due diligence and transaction records?
- At least 2 years
- At least 5 years
- Until the title deed is issued
- At least 10 years from the end of the relationship or transaction
Records must be kept for at least 10 years, longer if a competent authority asks. The guide also says due diligence must be completed before accepting any funds, and if it cannot be completed the deal must stop and a report be filed.
