Real estate agent commission in France
France sets no commission rate. Each agency fixes its own tariff, but it must publish it, VAT included, with a maximum and the name of the party who pays. The fee belongs to the holder of the carte professionnelle, and what reaches you depends on whether you are a salaried négociateur or a self-employed agent commercial in a network. Here is how it works in October 2026, with examples in euros.
The short version
- There is no legal fee scale. Agence Immobilière France, an industry blog, puts fees between 3% and 10% of the price, lower as the price rises, with an average of 4.5% to 5% for sales of €200,000 to €400,000.
- Fees must be shown TTC, with who pays and, since 1 April 2022, a maximum rate, in the window, inside and online (DGCCRF).
- About 70% of sale mandates put the fee on the seller, according to the same blog. When the buyer pays, transfer taxes are charged on the net seller price.
- No fee without a written mandate, and no fee without an actual sale. A clause charging a seller who finds the buyer alone is illicit.
- Network agents commerciaux keep a published share, from 69% to 75% at base and up to 89% to 100% at the top, minus a monthly pack.
- A salaried négociateur VRP earns at least €1,500 gross a month under IDCC 1527, which can be an advance on commissions (Kohen Avocats).
Usual rates
Agence Immobilière France gives this indicative scale for 2026:
| Sale price | Usual fee, TTC |
|---|---|
| Under €100,000 | 7% to 10% |
| €100,000 to €200,000 | 5% to 7% |
| €200,000 to €400,000 | 4% to 5% |
| €400,000 to €800,000 | 3.5% to 4.5% |
| Above €800,000 | 2.5% to 3.5% |
It puts traditional agencies at 4% to 6% and mandataire networks at 3% to 4.5%. The blog cites no primary source, so use it as a guide, not a rule.
What the rules say
Display. The arrêté of 10 January 2017 governs consumer information in property transactions. The DGCCRF summarises: fees TTC, stating who pays, displayed in the window, inside and on the website, accessible and up to date, and since the arrêté of 26 January 2022 with a maximum rate. A tariff “on quote only”, or showing only the buyer’s share, is not compliant. When the buyer pays, listings generally show the price with and without fees and the fee as a percentage; check the arrêté for the exact format.
Mandate. The fee and who pays must be written in the mandate, signed before any negotiation and entered in the registre des mandats.
Illicit clauses. The DGCCRF lists as illicit a clause making the seller pay when he finds the buyer himself, and charging a fee without an actual sale. Presenting a simple mandate as exclusive, or relying on an expired exclusivity, is misleading.
Exclusivity. Irrevocability is capped at three months. After that, Le Blog de L’Immobilier describes termination with 15 days’ notice by registered letter. Agree the duration in writing.
Who pays
- Seller-paid (à la charge du vendeur): the most common, about 70% of mandates (indicative). The price in the deed includes the fee.
- Buyer-paid (à la charge de l’acquéreur): the listing shows the price with and without fees. Transfer taxes are charged on the net seller price, which lowers them slightly.
- New builds: the developer is the seller, so the agent who brings a buyer is usually paid by the developer, under the developer’s own mandate.
Who keeps what
The fee is invoiced by the card holder. CNACIM is clear that an agent commercial cannot receive or hold client funds, so your share comes from the card holder, never from the client.
Agents commerciaux in networks
| Network | Base split | Top split | Monthly pack, excl. VAT |
|---|---|---|---|
| IAD France | 69% | up to 89% | €163 |
| Safti | 70% | up to 80% to 85% | €159 |
| Capifrance | 72% | up to 98% | about €205 |
| eXp France | at least 75% | 100% after €80,000 of commissions excl. VAT in the year | about €100 |
Sources: Maformationimmo (March 2026) for IAD, Safti and Capifrance; MeilleursRéseaux for eXp, based on network documents and agent testimony. Check the network’s own contract.
La Maison des Mandataires counted 47,000 network advisers at the end of 2025, handling 28% of intermediated sales.
Agents commerciaux in local agencies
No public scale exists. The share is set in your agent commercial contract, so negotiate it and get it in writing, with what happens to deals that close after you leave.
Salaried négociateurs
Kohen Avocats sets the minimum for a non-executive négociateur VRP under IDCC 1527 at €1,500 gross a month, €19,500 a year over 13 months. It can be paid as an advance on commissions, and pay is usually a fixed part plus commission. Salaried staff who are not VRP are covered by the national minimum wage, about €21,876 a year at 1 January 2026 according to LegalPlace.
Worked examples
These use example rates only. Your mandate and your contract decide. Where a split applies, we use the fee excluding VAT; check which base your contract uses.
Resale flat in Bordeaux, €300,000, 5% TTC paid by the seller. Fee: 300,000 x 5% = €15,000 TTC, invoiced by the card holder to the seller.
Same deal at IAD’s base split, with €12,500 of the fee excluding VAT. Your share: 12,500 x 69% = €8,625, before your own contributions and tax. Your pack over the year: 163 x 12 = €1,956 excluding VAT.
Villa near Cannes, €1,500,000, 3% TTC, at Capifrance’s base split, with €37,500 of the fee excluding VAT. Fee: €45,000 TTC. Your share: 37,500 x 72% = €27,000.
Flat in Lyon, €400,000 net seller, fee €20,000 TTC: who pays? Seller pays: deed at €420,000, transfer tax at 6.31% = €26,502. Buyer pays: deed at €400,000, transfer tax = €25,240. The buyer saves about €1,262 of tax, and the agency’s fee is the same (MesFraisNotaire rates).
Salaried négociateur VRP, 20% of the agency’s fee excluding VAT, one sale with €10,000 excluding VAT. Commission: €2,000. If your €1,500 minimum is an advance, check how it is set against commissions over the year. The 20% is an example, not a market rate.
Tax and contributions
As an employee, your employer deducts contributions from your pay. As an agent commercial, you pay your own contributions and income tax, usually under the micro-entreprise regime, plus your RCP insurance, your 42 hours of training and your network pack. Rates change each year, so get an accountant before your first invoice.
Practical points at signing
- Check the mandate states the fee, TTC, and who pays, and that it is in the register.
- Check the compromis repeats the same fee and party.
- The fee is due only if the sale happens, after the buyer’s 10-day withdrawal period and the deed.
- As an agent commercial, never take a deposit or cash from anyone.
What to check before you work a deal
- A signed mandate with the fee, who pays and any exclusivity.
- Your attestation d’habilitation is valid for this card holder.
- Your split and its base are in your contract.
- Any inter-agency split is agreed in writing before the viewing.
- The listing shows fees the way the arrêté requires.
Commission in France is free but tightly displayed, and only the card holder invoices the client. This guide was checked on the date shown above. It is general information, not legal or tax advice. CloserPass is not affiliated with the CCI, FNAIM, any network, agency or government body in France.
