Who can work as an agent in Morocco

Know the legal routes into the job for Moroccans and foreigners, the work and residence papers you need, and what is not allowed.

In many countries, the first question is “Am I allowed to be a broker?” In Morocco the answer is short: the activity itself is open to everyone. The real questions are about your business status, your work papers and your residence. This lesson walks through each route and is honest about the limits.

The activity is open to all

No Moroccan law defines or restricts the job of real estate agent. Le Brief confirmed in November 2025 that there is no licence, no professional card and no entry condition. Draft law 36.17 would change this, but Bladi reported in March 2025 that it was still not adopted, and we found no adoption as of October 2026.

So nationality is not a bar. A Moroccan or a foreigner can act as an agent. What changes is the legal frame you work in.

Route 1: employee of an agency or developer

This is the simplest route for a newcomer. The agency holds the business registration, and you sign an employment contract.

For Moroccans, it is an ordinary job contract.

For foreigners, two steps apply, as described by Upsilon Consulting:

  1. The ANAPEC certificate. Before hiring a foreigner, the employer normally needs a certificate from ANAPEC, the national employment agency, showing that no suitable Moroccan candidate applied. Upsilon describes a 15-day job posting and about 60 days in total.
  2. The work contract visa. The contract must follow the Ministry of Employment’s official model and be visaed through the TAECHIR platform (Labour Code Articles 516 to 520). The contract only takes effect from the date of the visa.

Who is exempt from ANAPEC

Upsilon lists these cases, among others:

  • Company managers, partners and shareholders.
  • Spouses of Moroccan nationals.
  • Foreigners born in Morocco.
  • Foreigners who have lived in Morocco as employees for more than 10 years.
  • Staff of Casablanca Finance City companies.
  • Nationals covered by bilateral agreements, such as Algeria, Tunisia and Senegal.

The work contract visa is still needed in these cases. Only the ANAPEC step falls away.

Route 2: founder or partner of your own agency

A foreigner can found or co-own a company, for example a SARL, and run it. Managers, partners and shareholders are exempt from the ANAPEC certificate, which makes this route attractive for experienced agents. You will see the set-up steps in the next lesson.

Remember that a company brings its own duties: bookkeeping, taxes, invoices and anti-money laundering checks. It is a real business, not a shortcut.

Route 3: auto-entrepreneur, if eligible

Morocco has a simplified auto-entrepreneur status for individuals. Humantal (January 2026) lists turnover caps of MAD 500,000 a year for trade and MAD 200,000 for services, with registration online at rn.ae.gov.ma or at a Barid Al-Maghrib post office.

Two warnings:

  • Eligibility is not confirmed. Property development is on the excluded list, but we could not confirm whether real estate intermediation is allowed. Check the official list before you rely on it.
  • Residence comes first. Upsilon Consulting says the status is open to residents, including foreign residents. A foreigner would first need a valid residence card.

Residence for foreigners

Under Law 02-03, a foreigner who stays in Morocco for more than 90 days needs a registration card (carte d’immatriculation) from the police (DGSN). It is valid for 1 to 10 years and renewable. A resident card becomes possible after four years of continuous legal residence.

Your work contract or your company is usually what supports the card application.

Buying property does not give you residency

Some newcomers hope to buy a flat and stay. ReaConsult explains that Morocco has no golden visa and no residence-by-investment route. A property can help a residence file as proof of housing, nothing more. If a client says a seller promised residency, tell them to check with the DGSN or an immigration lawyer.

What is not allowed, or not wise

  • Starting work before your contract is visaed. It has no effect until the visa date, which is a risk for you and the employer.
  • Working for cash with no contract, in the samsar style. You have no protection, and cash deals now carry real tax and compliance risks.
  • Assuming the auto-entrepreneur status covers you without checking the official list.
  • Staying beyond 90 days without applying for your registration card.
  • Telling clients that property brings residency. It does not.

How to choose your route

Your situationLikely best route
New to real estate, MoroccanEmployee of an agency
New to real estate, foreignEmployee, with TAECHIR visa
Experienced, with savingsYour own company, alone or with partners
Resident wanting a light set-upAuto-entrepreneur, only if eligible

Rules on work permits and residence change often. Check the official source before you act, and ask your future employer who will file your TAECHIR contract.

Key takeaways

  • Anyone can work as an agent: the activity has no nationality rule.
  • Foreign employees need a TAECHIR contract visa, and usually an ANAPEC certificate first.
  • Founders, partners and several other groups skip the ANAPEC step.
  • After 90 days, a foreigner needs a registration card under Law 02-03.

Practise these rules in Morocco rules training. In the next lesson, we set up your activity legally, step by step.
