Real estate agent commission in Georgia
Georgia has no legal commission rate and no agent licence, so the fee is whatever the agency and its client agree. TbilisiExperts (July 2026) says it plainly: agent commission is not regulated. The market still has clear habits. On a resale, the seller pays around 2% to 3%. On a new build, the developer pays and the buyer pays nothing. On a rental, the tenant pays about half a month’s rent. Here is how it works in Tbilisi and Batumi in October 2026.
The short version
- Resales: most agents charge about 3%, negotiable, usually paid by the seller (ExpatHub). GeorgiaExpats (2026) gives 2% to 3%, paid by the seller.
- The wider range on resales is 2% to 5%, sometimes split between both sides (TbilisiExperts).
- New builds: usually 0% for the buyer, with the developer paying the agency (TbilisiExperts; Real Estate Batumi).
- Rentals: usually 50% of one month’s rent, within a 30% to 50% range, paid by the tenant (Madloba).
- There is no published data on agent splits or salaries in Georgia.
- Two law firms report that brokerage is excluded from the 1% Small Business Status.
- Foreigners need a work permit to earn any of it, including as freelancers.
Who pays what
| Deal | Usual fee | Paid by |
|---|---|---|
| Resale | About 3% (ExpatHub), 2% to 3% (GeorgiaExpats) | The seller |
| Resale, wider range | 2% to 5%, sometimes split | Seller, buyer or both (TbilisiExperts) |
| Buyer search service | ExpatHub: 2.5%, minimum 7,500 GEL, plus VAT | The buyer (TbilisiExperts) |
| New build, off plan | Usually 0% for the buyer | The developer |
| Long-term rental | Usually 50% of one month’s rent | The tenant (Madloba) |
Real Estate Batumi, on its own site, advertises a 0% buyer fee, with the developer covering the agency’s fee. That is the standard pitch on new builds in Batumi, where foreigners bought 52% of flats in 2025 (Investor.ge, April 2026).
Put it in writing
With no legal rate, the written agreement is the only protection for both sides. It should state the rate or sum, the currency, who pays, when it is due (at signing or at registration with the Public Registry), whether VAT is added, and how a shared deal is split. Remember that adverts must show prices in GEL (ISET Policy Institute), even when the deal and the commission are agreed in USD.
Worked examples
We found no published data on how agencies share commission with agents in Georgia. The 50% agent share below is an assumption to show the method. Use your own contract’s figure.
1. A Tbilisi resale, 98,700 USD, 3% paid by the seller.
A 75 m² flat at the December 2025 secondary new-project average of 1,316 USD per m² (Galt & Taggart).
| Step | Calculation | Amount |
|---|---|---|
| Agency commission | 98,700 x 3% | 2,961 USD |
| Agent share at 50% | 2,961 x 50% | 1,480.50 USD |
2. A Vake resale at 2%, 152,955 USD.
A 55 m² flat at the Vake primary average of 2,781 USD per m² (Galt & Taggart), with the seller negotiating the fee down to 2%.
| Step | Calculation | Amount |
|---|---|---|
| Agency commission | 152,955 x 2% | 3,059.10 USD |
| Agent share at 50% | 1,529.55 USD |
A lower rate on a higher price can pay more than a full rate on a cheaper flat.
3. A Batumi off-plan sale, 63,000 USD, paid by the developer.
A 45 m² flat at 1,400 USD per m², near the August 2026 new-build average of 1,386 USD (Business Media Georgia). Developer rates are set in private agreements and are not published. We assume 3%.
| Step | Calculation | Amount |
|---|---|---|
| Developer pays the agency | 63,000 x 3% | 1,890 USD |
| Agent share at 50% | 945 USD | |
| Buyer’s agent fee | 0 |
Ask the developer when it pays: at signing, or in step with the buyer’s instalments.
4. A Tbilisi rental, 60 m².
At the 2025 average rent of 9.8 USD per m² a month (Galt & Taggart), the rent is about 588 USD.
| Step | Calculation | Amount |
|---|---|---|
| Agency fee, 50% of one month | 588 x 50% | 294 USD, paid by the tenant |
| Agent share at 50% | 147 USD |
How agents are paid
No public source gave salary or split figures for agents in Georgia. From how agencies charge, the likely set-ups are:
- A commission share on resale deals.
- A share of developer fees on off-plan sales.
- Rental and management fees. Tbilisi Property, for example, charges commission only on rental management.
Ask every employer for the share on your own listings, on agency leads, on developer deals and on rentals, and when each is paid.
Tax and permits
- The 1% status is not for brokers, according to two law firms. Legalese lists residential real estate brokerage among the activities excluded from Small Business Status, and Gegidze says brokering property disqualifies you. Plan on the standard regime and ask an accountant.
- Foreigners need a work permit since 1 March 2026, also as self-employed or IE. Legal.ge gives fees of 200 GEL standard and 400 GEL expedited, and the fine for working without one is 2,000 GEL for the worker and the employer.
Red flags
- A commission promised only verbally.
- Fees paid in cash or into a personal account.
- A freelance deal for a foreigner without a work permit.
- An accountant-free promise that “you only pay 1% tax”.
- A buyer charged a fee on a new build when the developer is already paying, without the buyer being told.
Agent commission in Georgia is not regulated, so the written agreement decides. This guide was checked on the date shown above. It is general information, not tax or legal advice. CloserPass is not affiliated with any agency, developer or government body in Georgia.
